Agreeing to our Terms is required for launching a charter or utilizing our Service. Access to the Service is not granted if you do not accept all parts of these terms.

2. Service Overview

SharedPublicCollective offers high-end yacht chartering services that include, but are not restricted to:

  • Yacht rentals for the day
  • Evening voyages
  • Executive retreats
  • Private functions
  • Extended charters

Service availability depends on several factors including weather. We maintain the right to amend or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

Charter reservation requirements include:

  • Minimum age of 18
  • Submission of accurate, full details
  • Initial deposit payment, as outlined in your confirmation
  • Acceptance of our Terms & Conditions

3.2 Confirmation

Confirmation of your reservation is secured only after payment receipt and our issuance of written acknowledgment. Service refusal is at our sole discretion.

3.3 Availability

Chart bookings are contingent upon ship availability and suitable weather. We will strive to accommodate your preferred scheduling.

4. Payment Terms

4.1 Pricing

All fees are denominated in € and are inclusive of all applicable taxes, unless specified otherwise. Prices are subject to alteration without prior announcement.

4.2 Payment Schedule

  • Deposit: 50% of overall charter cost, payable during reservation
  • Remaining amount: Payable 48 hours prior to yacht departure
  • Any additional charges: Payable by the end of the charter

4.3 Payment Methods

We accept various major credit cards, wire transfers, and certified checks. All payment processing is secured with encrypted methods.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Over 72 hours from departure: Full refund less processing charges
  • Within 24-72 hours of departure: Refund of 50%
  • Under 24 hours to departure: No refund issued

5.2 Weather Cancellations

In the case of unsafe weather as determined by the captain, we will offer:

  • A rescheduled charter on an alternative date without extra charges
  • A full refund if rescheduling isn't feasible

5.3 Mechanical Issues

Should there be a mechanical malfunction with the assigned vessel, we will make an effort to arrange an appropriate substitute. If this is not possible, a full reimbursement will be provided.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Adhere to all instructions from the crew
  • Utilize safety equipment as required
  • Disclose any health conditions that might compromise their security
  • Stay within designated sections of the ship

6.2 Prohibited Items

Certain items are prohibited on the vessel, namely:

  • Containers made of glass
  • Illegal materials
  • Weapons or firearms
  • Non-permissible control substances
  • Animals, except when pre-authorised

6.3 Conduct

Passengers are required to behave respectfully. If passenger conduct endangers safety or disrupts others' experiences, we have the authority to end a charter prematurely without issuing a refund.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the payment received for your charter. We do not account for:

  • Injuries that result from passenger carelessness
  • Personal item loss or damage
  • Indirect, consequence-based, or punitive damages
  • Delays from weather or conditions beyond our control

7.2 Insurance Coverage

Comprehensive marine insurance that covers both our vessels and operations is maintained by us. Passengers are responsible for procuring their own travel and personal insurance provisions.

7.3 Assumption of Risk

Engaging in our charter services signifies your recognition that marine activities carry inherent risks, and you take on the responsibility for your personal safety and welfare.

8. Modifications and Itinerary Changes

We reserve the discretion to adjust itineraries, pathways, or timetables due to weather, safety, or other operation-based needs. We will endeavor to offer alternate experiences of comparable value.

9. Force Majeure

We hold no liability for hold-ups, cancellations, or alterations resulting from circumstances beyond our power, these include, but are not confined to:

  • Extreme weather events
  • Natural catastrophes
  • Government directives
  • Port shutdowns
  • Vessel mechanical failures

10. Privacy and Data Protection

The handling of your personal data complies with our Privacy Policy. By employing our services, you consent to your data being collected and used as delineated in our Privacy Policy.

11. Intellectual Property

Copyright and trademark laws protect all materials on our website, such as text, illustrations, trademarks, and photographs. Reproduction, distribution, or creation of derivative works is not permissible without our explicit consent.
